JOB DESCRIPTION: ASSISTANT COMMONWEALTHS ATTORNEY I (ATTI)
At will prosecuting attorney position (JATTI); potentially eligible for Career Prosecutor designation.
This position represents the Commonwealth of Virginia and will primarily prosecute felonies and misdemeanors and some traffic infractions in the Juvenile and Domestic Relations District Court. One should expect to represent the Commonwealth in other Courts for cases such as misdemeanor appeals and felonies in Circuit Court (including jury trials) and on occasion this attorney may be assigned to prosecute such matters in the General District Court. Additionally our office attorneys may be assigned to the specialty dockets such as Recovery Court DUI Court Failure-to-Comply Docket and Therapeutic Docket. Our attorneys also represent the Commonwealth and/or the City of Staunton in civil cases as required by statute (for example restoration of firearm privileges and appeals of involuntary in-patient treatment). The attorney must be capable of managing a heavy caseload including preparing researching and prosecuting assigned cases. Must be skilled at legal research and drafting appellate briefs responses to motions to suppress jury instructions and other legal memoranda. In this position the attorney will also need to review police reports have interviews with victims and witnesses review body-worn camera videos have discussions with defense attorneys and police and draft pleadings and plea agreements.
The attorney must also be able to provide legal advice to law enforcement personnel regarding investigations (i.e. whether to place charges how to proceed on a pending case what type of follow-up is needed) during and after traditional work hours as well as assistance with law enforcement training. The attorney may be called upon to advise city officials concerning criminal enforcement procedures relating to building fire property maintenance and/or zoning code violations.
The work involves considerable public contact and requires independent judgment initiative tact and courtesy. The attorney must be able and willing to work with other staff and Director of the Victim-Witness Program as a team player and be willing to perform additional reasonable duties as requested.
SPECIAL REQUIREMENTS
Attorney must be able to work both independently and collaboratively in an office that values civility kindness initiative creativity humor sound judgment and skilled advocacy. Due to the high case load the attorney must be able to organize and work efficiently. While work is performed under the general direction of the Commonwealths Attorney and/or the Chief Deputy the attorney must be decisive and able to exercise discretion.
Licensed to practice law in Virginia and a member in good standing of the Virginia State Bar.
