Our Commercial Management Office is seeking a Senior Manager Contract Management to lead the commercial management for capital projects undertaken by the Capital Projects Group (CPG).
What will I be doing
- Manage the development and implementation of comprehensive strategies methodologies tools and techniques for commercial management excellence and continuous improvement including the validation ofMetrolinx project requirements (including feasibility studies and cost analyses as required) and recommend commercial strategies consistent with overall strategic goals of the Division.
- Develop contract negotiation governance and management strategies to ensure that contracts adhere to Metrolinx policies and procedures and to minimize corporate liability and risk throughout the contract lifecycle; Lead the review and analysis of the Divisions contract documents to ensure that the appropriate contracting strategy and contractual clauses are applied to reduce risk and protect the interests of Metrolinx.
- Support the development and leads the execution of the overall strategy for commercial management for contracts with Vendors and Partners in accordance with strategic and operational plans for the Division to ensure the successful outcomes and value for money objectives of the organizations large and complex operational initiatives.
- Collaborate with the both the Director and/or VP Commercial Management and Senior Legal Counsel to ensure corporate documents reflect commercial management strategy and sound commercial principles; Maintain active communication and collaborates with business unit leaders to develop new concepts design new programs discuss contracting models and provide commercial direction.
- Manage and monitors benchmarks and metrics and establishes a reporting functionality to appropriately gauge the alignment of business unit initiatives with corporate direction strategy and value for money principles.
- Monitor status of Key Performance Indicators (KPIs) on a monthly basis and lead a team to develop and update reporting for material projects and contracts.
- Provide expertise in contractual interpretation and provide guidance to staff in the management of change orders timing notifications and dealing with disagreements. Monitor contract amendments to ensure they are issued in writing and that negotiation and discussions are recorded.
- Build and manage relationships with a broad number of internal and external stakeholders/partners including 3rd party revenue partners provincial/federal/municipal governments agencies and/or communities leveraging those relationships to advance commercial operations program objectives;Deliver presentations attend meetings and acts as ambassador for the organization and its initiatives.
- Lead the resolution of issues of corporate significance as required to recover or protect Metrolinxs commercial reputation and ensure value for money and sound commercial decision-making.
- Identify industry best practices in contract administration and legal developments relating to contentious and non-contentious construction law issues that may impact future projects and contract development; Oversee the accurate accounting of risks and ensures risks are appropriately translated into financial reputational and operational and schedule risks and that mitigation measures are provided in sufficient detail.
- Effectively deal with significant commercial issues including complex engineering and operational and business challenges to ensure the completion of key projects and strategies;monitor applicable regulations codes and standards to ensure all legal obligations are met or exceeded;facilitates collaboration and cooperation between stakeholders and external vendors to ensure project delivery and issues resolution.
- Manage processes controls and measures to support the commercial management strategy monitors and ensures contract compliance and the financial viability of all business unit projects.
- Support compliance with Metrolinxs financial and budgeting programs and provide spending oversight with appropriate guidance and controls; Develops and manage operating budgets; taking corrective actions to address issues with adherence to budget and schedule commitments.
- Provide senior leadership oversight and direction to staff and project teams (e.g. defines team member roles responsibilities and expectations); deliver timely feedback to ensure a cohesive operational unit and the optimum use of team skills; manage staff and monitor work assignments to ensure adherence to timelines; monitor the achievement of performance objectives; develop and implement action plans to address performance gaps;provide orientation mentoring training and development opportunities lead succession planning and handling a broad range of employee relations matters
What Skills and Qualifications Do I Need
- Demonstrated experience in progressively responsible marketing or business roles related to the planning design construction commercializing assets increasing revenue and operation of rail and/or transit infrastructure and services and related works facilitating third party partnerships including a minimum of 5 years of experience managing large complex multi-year transit or transformation projects and/or operational contracts.
- Completion of a degree in Applied Science Engineering Architecture Marketing Business or a related discipline or an equivalent combination of education training and experience.
- Professional Engineer Ontario (.) Certified Engineering Technologist (C.E.T.) Ontario Association of Architects (OAA) Project Management Professional (PMP) and/or Certified Construction Contract Administrator (CCCA) designation would be an asset.
- Knowledge of Contract Law Canadian Construction Documents Committee documents (CCDC) Master Construction Operating and Service Agreements the Construction Act Occupational Health and Safety Act Environmental Assessment Act and the Professional Engineers Act contracts documents specifications and drawings and legal statutes and proceedings.
- Demonstrated experience with vendor management to evaluate project tenders and review consultant proposals; sound understanding of contracting principles practices rules regulations and procedures to assess risks and provide advice on procurement through the tendering process and the implications of the terms and conditions of contracts.
- Ability to plan set priorities schedule and manage deliverables for immediate and future needs.
- Familiarity with risk assessment methodology to identify and recommend areas of focus in the development of business cases and other contract related documentation.
- A valid drivers license is required to travel to various project locations public meetings etc. (approximately 5%). Must meet and maintain the corporate standard for a good driving record
