Start your journey towards success! DPS is currently accepting applications for an Agency Legal Consultant I - Hearing Officer/Chief Records Officer.

This is an INTERNAL POSTING open ONLYto currentNorth Carolina State Government and UNC System employees and eligible RIF candidates.

The Hearing Officer/Chief Records Officer (Agency Legal Consultant I) position will conduct employment related grievance hearings which concern DPS employees. In addition to serving as the Chief Records Officer/Hearings Officer this position will be responsible for other HR-related work and special projects as needed. Job duties for this position require driving a state vehicle. A valid drivers license must be obtained by date of hire.

Specific responsibilities related to employee grievances include:
  • Determining if the appeal is timely filed selecting a suitable location and notifying all parties by letter or email of the logistics of the hearing.
  • Obtaining and reviewing all evidence prior to the hearing (i.e. letters investigation documents witness statements police reports video applications screening tools job descriptions interview summaries previous disciplinary action performance evaluations medical reports etc.).
  • Notifying the parties prior to the hearing of issues to be addressed at the hearing; and notifying the parties prior to the hearing of witnesses who will testify at the hearing.
  • Conducting Step-2 Employee Advisory Hearings (EAH).
  • Preparing and submitting legal report with findings of facts conclusions of law and a draft recommendation for a final agency decision (FAD) to be reviewed by HR Management and the Office of General Counsel (OGC) and approved by the Secretary or the appropriate Authorizing Agency Official (AAO) prior to submission to OSHR for approval.
  • Ensuring grievances are handled in accordance with and as outlined in the OSHR Employee Grievance Policy.
  • Researching relevant law in preparation for employee hearings.

This position will also serve as the Chief Records Officer (CRO) for the agency. Specific responsibilities include:
  • Coordinating with the Government Records Section on all agency requests for records assistance training and other offered consultative services.
  • Coordinating interactions between the agency business units and the Department of Natural and Cultural Resources in preparing an inclusive inventory of and schedule for records in agency custody and in establishing a time period for the retention and disposal of each records series.
  • Assuring that public records are kept in secure but accessible places.
  • Assisting in the timely transfer of semi-active records to the State Records Center.
  • In cooperation with the Department of Natural and Cultural Resources establishing and maintaining a program for the selection and preservation of agency records considered essential to the operation of government and to the protection of the rights and interests of citizens.
  • Participating in the design and implementation of electronic records initiatives.
  • Coordinating with the DPS Office of Policy and Strategic Planning (OPSP) to provide oversight and technical assistance to Divisions and Sections on Electronic Records and Imaging Policy and Procedures (ERIPP).
  • Responsible for archiving the outgoing Administration.

This position functions as a Hearing Officer within the agency. Specific responsibilities include:
  • Participating in continuing legal education to maintain law license (if applicable) and when available with respect to the areas of law that are relevant to the Attorney-Hearing Officer position.
  • Participating in pre-hearing settlement negotiations with parties drafting and reviewing proposed settlement agreements in pending grievances which settle and are then forwarded to the Secretarys staff for approval.
  • Referring and consulting with ER/EEO Manager when additional issues are referenced that may require EEO involvement.
  • Ensuring compliance with timeframes established by policy in resolving employee grievances.
  • Conducting hearings in person: traveling to the DPS employees work location may be required.
  • Consulting with the Office of Human Resources (OSHR) on any issues that are beyond the control of the agency.

This is a full-time position (40 hours per week) withState Benefits including paid vacation paid sick leave paid holidays retirement and health insurance.   • Licensed to practice law in the state of North Carolina.
  • Ability to collect analyze and draw valid conclusions from oral and documentary evidence and to render determinations from facts and testimony obtained at hearings utilizing applicable laws and policies.
  • Ability to devise and implement procedures for conducting employee grievance hearings.
  • Ability to preside over hearings with discretion fairness and diplomacy.
  • Ability to prepare concise yet comprehensive legal reports of employee advisory hearings and recommendations for the final agency decision.
  • Ability to effectively manage the hearing dockets and the overall use of time.
  • Ability to make oral presentations to the Secretary or Chief Deputy Secretaries which requires effective legal research skills as well as effective oral and written communication skills and requires the ability to explain legal issues in a manner that is understandable to non-lawyers.
  • Ability to interpret laws rules regulations and court decisions.
  • Ability to analyze facts evidence and legal documents.
  • Ability to express legal interpretations or conclusions or law clearly and logically in oral and written form.
  • Ability to maintain effective working relationships with the public and other persons contacted in the course of work.

Minimum Education and Experience Requirements
