THE STARTING SALARY FOR THIS POSITION IS LIMITED TO $116147 $130266. Salary offers for the selected candidate are based on the candidates education and experience related to the position as well as our agency budget and equity.

The Services to State Agencies Section provides a full range of legal services including litigation before administrative state and federal tribunals to several State agencies boards and commissions.

This is a unique opportunity to work on interesting cases in state federal and administrative tribunals for the North Carolina Department of Natural and Cultural Resources (NCDNCR). The North Carolina Department of Natural and Cultural Resources oversees the states resources for the arts history libraries and nature. This work includes the defense of state and state officials positions with respect to a wide range of fascinating issues which may range from the protection of North Carolinas cultural treasures and artifacts to providing advice to park rangers to advice and legal representation of NCDNCR officials when they have been sued in connection with the alleged constitutional violations. You will have the chance to significantly impact public service while advancing your legal career in a challenging supportive and rewarding environment.

The North Carolina Department of Justice led by the Attorney General of North Carolina represents the state state agencies and elected officials and defends the rights of the people of North Carolina. The Department handles all state criminal appeals cases and assists district attorneys with complex criminal cases at their request. Additionally the Department of Justice includes the North Carolina State Crime Lab the North Carolina Justice Academy and the Sheriffs and Criminal Justice Education and Training Standards Divisions.

The Primary Purpose of the Position
This attorney represents the NC Department of Natural and Cultural Resources (NCDNCR) in litigation in state federal and administrative courts in litigation. This attorney also assists NCDNCR with HR and personnel matters public inquiries and occasional representation of NCDNCR boards and commissions as needed. This position may be asked to assist with the sections other critical litigation needs on a casebycase basis. It is an exciting position for a strong litigator wishing to continue honing their litigation skills in the interesting area of law that touches upon our States heritage and is important to the State of North Carolina at large.

Represent Client Agencies and Employees in Civil Litigation
The attorney in this position independently prosecutes civil actions brought by the client agency and independently defends administrative and civil actions brought against the client agency and employees in State and federal trial and administrative courts. These duties involve analyzing the merits of a case the legal issues and the defenses performing legal research preparing pleadings conducting discovery preparing briefs and memoranda of law pretrial motion practice conducting settlement negotiations bench or jury trial posttrial motion practice perfecting appeals preparation of appellate briefs and oral arguments in appellate courts. This position is solely responsible for all aspects of a case.

At this level cases involve major state and federal constitutional issues public policy concerns or issues that may have an extreme impact on economic conditions natural resources and a wide segment of the general public which might include other states or even nationally. Appearing before the General Assembly on behalf of the NC DNCR may be required for this position.

Advise State Agencies Board and Commissions
The attorney in this position will propose solutions to resolve legal problems affecting agency operations and participate in settlement negotiations where appropriate. Advising the NC DNCR requires preparing and reviewing complex contracts reviewing and revising current and proposed administrative policies and drafting proposed legislation.

Respond to inquiries
This position makes appropriate oral or written responses to inquiries relating to legal matters. The attorney in this position must analyze the inquiry and prepare a response including necessary research and contacts.

Represent the State in Criminal Appeals
This position acts as attorney for the State when convicted criminals appeal from judgments entered pursuant to trial or engage in other postconviction practices including motions for appropriate relief stay of sentence and certiorari or supersedeas. Presenting oral arguments in the appellate courts and communicating with the prosecuting district attorney may also be required.

Minimum Education and Experience Requirements

Licensed to practice law by the North Carolina State Bar and five years of progressively responsible professional legal experience.NOTE: GS 1142 and 1146 make it the duty of the Attorney General of NC to represent the State of North Carolina in all litigation unless another statute specifically states otherwise.

Applicants seeking Veterans Preference must attach a copy of their DD214 or discharge orders.

Applicants seeking National Guard Preference must attach a NGB 23A (RPAS) if you are a current member of the NC National Guard in good standing. If you are a former member of the NC National Guard who served for at least 6 years and was discharged under honorable conditions you must attach either a DD256 or NGB 22.
