This position is located in the Insurance Fraud Division.

Job Purpose
The Insurance Fraud Division is a unit within the South Carolina Department of Insurance that investigates and prosecutes insurance fraud cases referred to the Department and coordinates the Departments fraud enforcement policy. Under general supervision of the Insurance Fraud Division Director this prosecutor position is responsible for prosecution of insurance fraud cases brought on behalf of the State of South Carolina.

The following duties ARE NOTintended to serve as a comprehensive list of all duties performed by all employees in this classification only a representative summary of the primary duties and responsibilities.- Responsible for prosecution of a range of insurance fraud cases assigned or referred to the Insurance Fraud Division which may include complex highprofile litigation and other matters that may involve substantial public safety concerns.
- Complies with all rules regulating professional responsibility including specific rules addressing the prosecutorial function.
- Conducts legal research and prepares memoranda discovery requests motions and other responses indictments and arrest warrants.
- Presents witnesses photographs objects and other evidence of insurance fraud committed by the accused in court.
- Interviews witnesses victims and investigators.
- In consultation with the Insurance Fraud Division Director determines the charges to be brought against the alleged perpetrator and the punishment to be sought.
- Prepares statement forms motions notices proposed jury instructions and other court documents.
- Makes evaluates negotiates and receives plea offers.
- Oversees or assists investigators detectives and other law enforcement while gathering evidence.
- Produces information and other documents to defendants or their lawyers as requested and required by the laws of the State of South Carolina.
- Explain the reason and process for certain decisions to victims or their families.
- May perform other related duties as required.
Minimum and Additional Requirements
A juris doctor degree or its equivalent from an accredited law school be a member of the South Carolina Bar in good standing and completion of all Rule 403 requirements. Preferred Qualifications
Experience in insurance law and/or criminal court experience working in a Solicitors office Public Defenders office or similar agency is preferred.
Additional Comments
The successful candidate:
- Must be able to effectively interpret statutes and rules applying criminal law to facts and determining the significance of testimony or other items of evidence. The analysis also consists of assessing the credibility of witnesses based on factors such as bias or inconsistency in statements.
- Must have the ability to fairly and impartially decide whether and how to prosecute accused persons and avoid ethical lapses such as withholding evidence that may negate guilt relying on false evidence and mistreating the law or facts.
- Must be able to effectively organize and apply the theories practices and principles of effective management in order to oversee handle and prepare multiple cases for trial or plea and manage the caseload of the Insurance Fraud Division.
- Must be able to effectively communicate orally and in writing on behalf of the State of South Carolina to effectively advocate on behalf of the State of South Carolina.
- Must satisfactorily complete a DRUG SCREENING CREDIT CHECK DELINQUENT TAX CHECK ATTORNEY GRIEVANCE CHECK AND SLED BACKGROUND CHECK.
- Must be willing to travel in and outside the State of South Carolina as required and be available oncall or after hours.
Educational Credentials:
