A. POSITION PURPOSE
The Director of Equal Opportunity and Title IX develops and implements the program policies and initiatives of the Office of Equal Opportunity and Title IX. The Director also implements administers and monitors the Universitys compliance regarding civil rights laws including federal and state equal opportunity/nondiscrimination laws and regulations Title IX the California Fair Employment and Housing Act the Violence Against Women Act the Clery Act and related University policies. As part of this responsibility the Director also serves as the Universitys Title IX Coordinator. The Directoroversees all aspects the Universitys prompt and equitableresolution ofreports of discrimination harassment and retaliation and sexual misconduct. The Director is also responsible for leading new and supporting existing Universitywide programs and initiatives designed to prevent discrimination harassment and sexual violence and provide education to students faculty and staff on such issues. In addition the Director works closely with University leadership faculty staff and students to advance the Universitys commitment to diversity equity and inclusion by improving the Universitys capacity to attract retain and leverage a diverse campus community in support of academic Director is responsible for the strategic and operational functions of the department and serves as the fiscal administrator. Working in collaboration with the Universitys ADA/504 Coordinator the Director also supports compliance with nondiscrimination regulations in accordance with the Americans with Disabilities Act (ADA) and Section 504 of the Rehabilitation Act of 1973. This position reports to the Vice President for Inclusive Excellence.
B. ESSENTIAL DUTIES AND RESPONSIBILITIES
1. Manage Develop & Guide Office of Equal Opportunity and Title IX 30
Provide leadership direction and supervision for all activities and personnel of the Office for Equal Opportunity and Title IX including consulting with relevant policymaking bodies and senior personnel for the purpose of advising clarifying and identifying necessary action to eliminate discrimination in all educational programs and activities and to ensure equal access to facilities opportunities and resources in compliance with federal and state nondiscrimination laws and regulations;
Coordinate Universitywide equal opportunity/nondiscrimination and Title IX efforts including the development implementation and monitoring of appropriate disclosures policies procedures and practices requiring the prompt and equitable resolution of all complaints pursuant to Title IX and equal opportunity/nondiscrimination laws regulations and University to students faculty administrators and staff policies;
Administer and provide leadership for continued development and implementation of University equal opportunity/nondiscrimination policies and resolution procedures that reflect input from the broader campus community and the evolution of changing federal and state regulations pertaining to civil rights investigation and due process requirements;
Serve as a consultant and partner with the Presidents Office Provosts Office Office of Inclusive Excellence Office for Student Life Human Resources the Office of the General Counsel and other campus partners regarding federal and state laws that prohibit discrimination harassment and sexual misconduct.
Prepare quarterly reports for Senior Leadership and Deputy Title IX coordinators as appropriate detailing; current caseload; high profile investigations; appeals in progress; updates on faculty/staff participation in required training workshops; and discrimination complaints filed with external agencies.
Manage and guide equal opportunity/nondiscrimination and Title IX compliance efforts of other campus/school delegates departments and offices (e.g. deputy Title IX coordinators investigators student conduct/discipline victim services campus safety health services counseling services student affairs human resources faculty/academic affairs and Athletics etc.; and
Organize and maintain annual database disposition reports and other records regarding equal opportunity/nondiscrimination and Title IX compliance including the development of annual reports of the number and nature of filed complaints and the disposition of said complaints data collection climate assessment and incident/pattern monitoring etc.;
Responsible for and manage department budgets including educational programs and materials and professional development (i.e. outside vendors investigators consultants and retainer agreements).
2. Conduct Consultations Investigations and issue Dispositions 25
Conduct and/or oversee the prompt effective and equitable intake investigation processing issuing of findings of fact and timely resolution (informal and formal resolution) in accordance with University policies and applicable law and investigation and grievance procedures of all instances of discrimination harassment retaliation and/or sexual misconduct made known to responsible employees and/or reported or filed by students faculty employees third parties or by members of the broader community;
Refer complaints or inquiries for further investigation to the appropriate University resource(s) for resolution as appropriate under University policy;
Provide appropriate notice of an investigation; determine the extent of an investigation oversee investigation efforts; ensure provision of initial remedial actions; assure compliance with timelines; deliver appropriate notice of charge notice of hearing (when applicable) notice of outcome and remedies and provide a repository for and source of institutional recordkeeping;
Appoint train and supervise investigators and any deputy coordinators;
Coordinate with with local law enforcement agencies victim services district attorneys office and others as necessary and in accordance with operating MOU agreements;
Manage the Universitys hearing officer and appeal officer training and ensure that the officers participate in annual training and remain updated on current Title IX regulations state and federal laws and University policy as it pertains to equal opportunity/nondiscrimination.
3. Manage Institutional Monitoring and Compliance. 10
Monitor the Universitys compliance with policies against unlawful discrimination unlawful harassment and sexual misconduct and related procedures to ensure that its policies and procedures comply with Title IX the California Fair Employment and Housing Act the Clery Act as amended the Violence Against Women Act and other federal and state equal opportunity/nondiscrimination laws and regulations.
In collaboration with the Office of the General Counsel serve as a contact for government inquiries pursuant to equal opportunity/nondiscrimination and Title IX University compliance and manage the filing of all relevant agency reports and additional ones as requested by the Vice President for Inclusive Excellence and Senior Leadership.
Manage and lead efforts to coordinate compliance with University resolution agreements with the US Department of Education Office for Civil Rights US Department of Justice Office for Civil Rights and OFCCP as necessary;
Appoint annually train and oversee Deputy Title IX Coordinators investigators and other University personnel responsible for investigation or response to incidents of unlawful discrimination harassment and/or sexual misconduct including the Office of Student Life Human Resources and the Provosts Office; Oversee and monitor Title IX and NCAA gender equity compliance in Athletics and Club Sports;
Manage training for all faculty and staff responsible for implementing applicable grievance procedures regarding equal opportunity and Title IX;
Stay abreast of changes and trends in equal opportunity/nondiscrimination federal and state laws procedures regulations and current cases in higher education and in the workplace;
4. Equal Opportunity/Affirmative Action Plan (AAP) 15
Provides leadershipand guidance to the University community on equity in all personnel actions and is responsible for development and implementation of the Universitys Affirmative Action Plan under Executive Order 11246 and related laws and regulations;
Maintain monitor and audit the Universitys EEO/Affirmative Action Plan and programs to ensure the attainment of the Universitys goals and objectives;
Designs implements and maintains an EEO audit and reporting system which measures the effectiveness of the Universitys Affirmative Action plan evaluates compliance and determines whether the Universitys goals and objectives have been attained in partnership with Human Resources Provosts Office and Office of Inclusive Excellence.
Ensure compliance with OFCCP requirements and regulations and other federal and state guidelines and mandates relative to equal opportunity employment;
Communicate to supervisors and managers regarding the Universitys EEO/Affirmative Action responsibilities and goals; and
Coordinate the implementation of any necessary remedial action to meet AAP compliance requirements and goals.

E. QUALIFICATIONS

1. Knowledge
Extensive legal background and experience in civil rights compliance and thorough knowledge of the California Fair Employment and Housing Act and other state equal opportunity laws federal equal opportunity laws (e.g. Title VI Title VII Title IX Section 504 of the Rehabilitation Act and the ADA) and other federal and state laws and regulations applicable to institutions of higher education.
Significant knowledge and experience conducting investigations alleging discrimination harassment and sexual misconduct/sexual violence.

4. Education
A Masters Degree in social work psychology or forensic psychology required.
Higher education administration or other relevant discipline is strongly preferred.
JD or equivalent from an accredited law school is strongly preferred.
5. Experience
Minimum of 7 years of progressively responsible experience in a related field required.
Graduate training in law higher education administration or other relevant discipline is required.
Experience conducting investigations alleging harassment and/or discrimination.
Knowledge and experience of issues related to genderbased violence.
Higher education experience is strongly preferred.
